Algemene Voorwaarden Majid Gym
1. Algemeen
1.1. Zodra u in de Virtuagym-app de lidmaatschapsovereenkomst (verder te noemen: de Overeenkomst) digitaal aanvinkt en hiermee akkoord gaat, wordt u lid (hierna: het Lid) van Majid Gym.
1.2. Deze algemene voorwaarden zijn van toepassing op alle diensten van Majid Gym en beheersen daarmee de rechtsverhouding tussen Majid Gym en het Lid.
1.3. Het Lid verklaart op de hoogte te zijn van en akkoord te gaan met de huisregels en algemene voorwaarden van Majid Gym. Deze zijn beschikbaar in de club, via de website en in de Virtuagym-appomgeving van Majid Gym.
2. Lidmaatschap
2.1. Het lidmaatschap is strikt persoonlijk en kan alleen met voorafgaande toestemming van Majid Gym worden overgedragen.
2.2. Het Lid kan gedurende de openingstijden trainen bij Majid Gym. Meer informatie over soorten lidmaatschappen is beschikbaar in de club, op de website en in de Virtuagym-appomgeving.
2.3. Majid Gym behoudt zich het recht voor om bij inschrijving identificatie van nieuwe leden te vragen.
3. Betaling
3.1. Het lidmaatschapsgeld wordt via SEPA automatische incasso uitgevoerd, met Mollie als betalingsprovider. Het Lid is verplicht tijdig te zorgen voor voldoende saldo op de opgegeven rekening.
3.2. Betaling vindt maandelijks vooraf plaats.
3.3. Bij niet-tijdige betaling is het Lid zonder verdere ingebrekestelling in verzuim. Majid Gym behoudt zich het recht voor om openstaande bedragen via incassobureaus te innen.
3.4. Alle prijzen zijn inclusief BTW. Majid Gym is te allen tijde gerechtigd om haar tarieven aan te passen. Eventuele wijzigingen worden minimaal één maand van tevoren aangekondigd via de in artikel 10 beschreven communicatiekanalen.
4. Opzegging
4.1. Het lidmaatschap geldt voor een vaste periode van 12 maanden. Na afloop van de initiële 12 maanden wordt het lidmaatschap automatisch verlengd op maandelijkse basis, tenzij opgezegd.
4.2. De opzegging kan schriftelijk of digitaal worden ingediend via e-mail naar majidgymhoofddorp@gmail.com.
4.3. Indien een Lid het lidmaatschap opzegt binnen de eerste 12 maanden, blijft hij verplicht het resterende lidmaatschapsgeld voor deze periode te voldoen.
5. Tijdelijke Opschorting
5.1. In geval van langdurige ziekte, blessure, zwangerschap of andere medische omstandigheden kan het Lid het lidmaatschap tijdelijk laten opschorten, waarbij de duur van deze opschorting naar redelijkheid door Majid Gym wordt bepaald.
5.2. Opschorting is alleen mogelijk na het overleggen van een geldige doktersverklaring.
5.3. Tijdens de opschorting stopt de betalingsverplichting en wordt de einddatum van de Overeenkomst verlengd met de duur van de opschorting.
6. Privacy
6.1. Majid Gym verwerkt persoonsgegevens van het Lid op behoorlijke en zorgvuldige wijze in overeenstemming met de Algemene Verordening Gegevensbescherming (AVG). Door akkoord te gaan met deze algemene voorwaarden, stemt het Lid tevens in met het privacybeleid van Majid Gym.
6.2. Persoonsgegevens (zoals naam, contactgegevens, geboortedatum, betaalinformatie en trainingsvoorkeuren) worden uitsluitend gebruikt voor administratieve, communicatieve en bedrijfsinterne doeleinden binnen Majid Gym en worden bewaard zolang dat nodig is voor deze doeleinden.
6.3. Majid Gym kan tijdens lessen foto’s en video’s maken voor gebruik op sociale media en promotiemateriaal. Hierbij wordt rekening gehouden met de privacy van Leden. Er worden geen foto’s of video’s gemaakt tijdens ladies only groepslessen.
7. Huisregels
7.1. Het Lid is verplicht de huisregels van Majid Gym na te leven. Deze regels zijn beschikbaar in de club, op de website en in de Virtuagym-appomgeving.
7.2. Majid Gym behoudt zich het recht voor om bij schending van de huisregels het lidmaatschap per direct te beëindigen zonder restitutie.
8. Aansprakelijkheid
8.1. Majid Gym is niet aansprakelijk voor enig letsel, ongeval, of zoekgeraakte voorwerpen van welke aard of oorzaak dan ook, behoudens in geval van opzet of bewuste roekeloosheid door Majid Gym of haar leidinggevenden.
8.2. Het Lid wordt geadviseerd een passende verzekering af te sluiten voor persoonlijke ongevallen en eigendommen.
9. Tariefaanpassingen
9.1. Majid Gym behoudt zich het recht voor om haar tarieven aan te passen.
9.2. Tariefwijzigingen worden minimaal één maand van tevoren schriftelijk of digitaal gecommuniceerd aan de Leden conform artikel 10.
10. Communicatie en Informatievoorziening
10.1. Officiële mededelingen vanuit Majid Gym, waaronder tariefwijzigingen of wijzigingen in de algemene voorwaarden, worden via het sociaal-tabblad in de Virtuagym-appomgeving gecommuniceerd.
10.2. Het Lid is zelf verantwoordelijk voor het up-to-date houden van zijn of haar contactgegevens in de Virtuagym-app. Indien het Lid niet regelmatig de communicatiekanalen raadpleegt, komen de gevolgen hiervan voor eigen rekening en risico van het Lid.
11. Uitval van Diensten en Wijzigingen in Aanbod
11.1. Majid Gym behoudt zich het recht voor om de dienstverlening tijdelijk aan te passen, te onderbreken of faciliteiten te sluiten, bijvoorbeeld bij verbouwingen, onderhoud, wijzigingen in openingstijden, beperkte beschikbaarheid van faciliteiten of overmachtssituaties.
11.2. Indien door dergelijke omstandigheden de toegang tot diensten van Majid Gym tijdelijk beperkt is, geeft dit het Lid geen recht op schadevergoeding of restitutie van lidmaatschapsgeld, tenzij Majid Gym op eigen initiatief anders besluit.
11.3. Onder overmacht wordt verstaan elke van de wil van Majid Gym onafhankelijke omstandigheid waardoor de nakoming van de Overeenkomst redelijkerwijs door Majid Gym niet kan worden verlangd.
1. General
1.1. As soon as you digitally confirm and agree to the membership agreement (hereinafter referred to as: the Agreement) in the Virtuagym app, you become a member (hereinafter: the Member) of Majid Gym.
1.2. These general terms and conditions apply to all services provided by Majid Gym and thus govern the legal relationship between Majid Gym and the Member.
1.3. The Member declares to be aware of and to agree with the house rules and general terms and conditions of Majid Gym. These are available at the club, on the website, and within the Virtuagym app environment of Majid Gym.
2. Membership
2.1. The membership is strictly personal and can only be transferred with prior permission from Majid Gym.
2.2. The Member may train at Majid Gym during opening hours. More information about types of memberships is available at the club, on the website, and in the Virtuagym app environment.
2.3. Majid Gym reserves the right to request identification from new members upon registration.
3. Payment
3.1. Membership fees are collected via SEPA direct debit, with Mollie as the payment provider. The Member is obliged to ensure there are sufficient funds in the designated account in a timely manner.
3.2. Payment is made monthly in advance.
3.3. If payment is not made on time, the Member is in default without further notice of default. Majid Gym reserves the right to collect outstanding amounts through collection agencies.
3.4. All prices include VAT. Majid Gym is entitled at all times to adjust its rates. Any changes will be announced at least one month in advance via the communication channels described in Article 10.
4. Termination
4.1. The membership is valid for a fixed period of 12 months. After the initial 12 months, the membership is automatically renewed on a monthly basis, unless it is terminated.
4.2. Termination can be submitted in writing or digitally via email to majidgymhoofddorp@gmail.com.
4.3. If a Member terminates the membership within the first 12 months, he/she remains obliged to pay the remaining membership fees for that period.
5. Temporary Suspension
5.1. In case of long-term illness, injury, pregnancy, or other medical circumstances, the Member may temporarily suspend the membership, with the duration of the suspension reasonably determined by Majid Gym.
5.2. Suspension is only possible after submitting a valid medical certificate.
5.3. During the suspension, the payment obligation is paused, and the end date of the Agreement is extended by the duration of the suspension.
6. Privacy
6.1. Majid Gym processes the Member’s personal data in a proper and careful manner in accordance with the General Data Protection Regulation (GDPR). By agreeing to these general terms and conditions, the Member also agrees to Majid Gym’s privacy policy.
6.2. Personal data (such as name, contact details, date of birth, payment information, and training preferences) are used exclusively for administrative, communicative, and internal business purposes within Majid Gym and are retained as long as necessary for these purposes.
6.3. Majid Gym may take photos and videos during classes for use on social media and promotional material. The privacy of Members will be taken into account. No photos or videos will be taken during ladies-only group classes.
7. House Rules
7.1. The Member is obliged to comply with Majid Gym’s house rules. These rules are available at the club, on the website, and in the Virtuagym app environment.
7.2. Majid Gym reserves the right to immediately terminate the membership without refund if the house rules are violated.
8. Liability
8.1. Majid Gym is not liable for any injury, accidents, or lost items of any nature or cause whatsoever, except in the case of intent or gross negligence by Majid Gym or its management.
8.2. The Member is advised to take out appropriate insurance for personal accidents and property.
9. Rate Adjustments
9.1. Majid Gym reserves the right to adjust its rates.
9.2. Rate changes will be communicated to Members at least one month in advance, in writing or digitally, in accordance with Article 10.
10. Communication and Information Provision
10.1. Official announcements from Majid Gym, including rate changes or changes to the general terms and conditions, will be communicated via the social tab in the Virtuagym app environment.
10.2. The Member is responsible for keeping his or her contact details up-to-date in the Virtuagym app. If the Member does not regularly check the communication channels, the consequences are at the Member’s own risk.
11. Service Interruptions and Changes in Offerings
11.1. Majid Gym reserves the right to temporarily adjust, interrupt, or close facilities, for example due to renovations, maintenance, changes in opening hours, limited availability of facilities, or force majeure situations.
11.2. If, due to such circumstances, access to Majid Gym’s services is temporarily limited, this does not entitle the Member to compensation or a refund of membership fees, unless Majid Gym decides otherwise on its own initiative.
11.3. Force majeure means any circumstance beyond the control of Majid Gym that prevents the fulfillment of the Agreement from reasonably being demanded of Majid Gym.
